About the Committee

The Supreme Court created the Judicial Committee on Sustainability and Environmental Concerns in furtherance of its goals of environmental sustainability. This Committee is mandated to introduce and implement climate change initiatives within the Judiciary and review the Rules of Procedure for Environmental Cases. It is also responsible for creating avenues for dialogue between the Judiciary and other stakeholders, i.e., the business community, the academe, and environmental professionals and advocates, to review the extraordinary remedies of the writ of kalikasan and continuing mandamus and streamline their procedures and processes. These initiatives are re-emphasized in the Supreme Court’s five-year Strategic Plan for Judicial Innovations 2022-2027 under the leadership of Chief Justice Alexander Gesmundo. 

The first committee meeting on August 24, 2023 was led by Senior Associate Justice Marvic M.V.F. Leonen and Associate Justice Maria Filomena Singh, and attended by representatives from the Supreme Court, trial courts, academe, and legal practitioners. 

History and Formation

The Judicial Committee on Sustainability and Environmental Concerns was established under Memorandum Order No. 75-2022 in response to the Supreme Court’s commitment to addressing the escalating impacts of climate change on the Philippines. With the growing threat of climate change and the far-reaching effects it poses on environmental health, the Supreme Court recognized the critical role of the Judiciary in promoting sustainable practices and fostering resilience against environmental risks.

 

The roots of the Committee trace back to a landmark decision on December 18, 2008, in the case of Metro Manila Development Authority v. Concerned Residents of Manila Bay, where the Court En Banc highlighted “the need to address environmental pollution as a cause of climate change.” This decision underscored the judiciary’s recognition of environmental pollution’s direct link to climate change and ordered thirteen government agencies to “clean up, rehabilitate, and preserve Manila Bay.” Subsequently, the Manila Bay Advisory Committee was created in February 2009 to monitor and validate the efforts of these agencies, solidifying the Supreme Court’s proactive stance on environmental issues.

 

In light of the worsening climate crisis and its implications beyond Manila Bay, the Supreme Court expanded its environmental advocacy through the creation of the Judicial Committee on Sustainability and Environmental Concerns in 2022. This newly formed Committee subsumed the responsibilities of the Manila Bay Advisory Committee and broadened its scope to address climate change impacts nationwide. Headed by Senior Associate Justice Marvic Mario Victor F. Leonen, the Committee is tasked with pioneering judicial policies and initiatives that respond to environmental challenges across the Philippines.

 

The Committee’s primary functions encompass:

 

  • The introduction of climate change initiatives tailored to the Judiciary’s unique role.
  • A comprehensive review of environmental rules, including the Writ of Kalikasan and Writ of Continuing Mandamus.
  • Capability building for judiciary members on domestic and international environmental issues and remedies.
  • Establishing forums for open dialogue among the Judiciary, business sectors, environmental professionals, and advocates.

The Judicial Committee on Sustainability and Environmental Concerns aims to align the judiciary with global environmental standards, positioning it as a leading advocate for climate action and environmental preservation within the Philippine government. This Committee stands as a testament to the Judiciary’s dedication to both environmental stewardship and the long-term welfare of the Filipino people.

Key Initiatives and Projects

In its inception meeting on August 24, 2023, Senior Associate Justice Marvic M.V.F. Leonen discussed the possibility of revising the Rules of Procedure for Environmental Cases. This will entail the creation of technical working groups from various sectors, namely the trial and appellate courts, academe, legal profession, civil society organizations, and the business sector in order to gather insights regarding their sectors’ respective concerns through focus group discussions.

Appellate courts

Led by Justice Wilhelmina B. Jorge-Wagan, the TWG for the appellate court organized a focus group discussion and developed a detailed table outlining the proposed amendments for the Rules of Procedure for Environmental Cases (RPEC). This table offered valuable insights into the challenges encountered by environmental law practitioners, particularly regarding the application of the writ of kalikasan. The TWG also seeks to incorporate perspectives from the appellate courts in Cebu and Cagayan de Oro.

The technical working group for trial courts discussed their proposed revisions to the Rules, including provisions on SLAPP and the precautionary principle, in the two-day focus group discussion in July 2024. 

Trial courts

Headed by RTC Judge Byron G. San Pedro and MTC Judge Catherina N. Manzano, the TWG for trial courts held a focus group discussion on July 4 to 5, 2024 on the procedural aspects of applying environmental laws. The group also developed a detailed table of proposed amendments to the RPEC

Civil Society Organizations

The TWG for civil service organizations, led by Atty. Maria Paz Luna, collaborated to create a detailed matrix and conducted department interviews. Their in-person focus group discussion on August 27 to 28, 2024, which included law practitioners, environmental advocates, and IP leaders, offered valuable insights into the experiences of those working on the ground. This helped ensure that the proposed amendments to the RPEC would be more comprehensive and responsive to real-world challenges.

The technical working group for civil society organizations, led by Atty. Maria Paz Luna, met in August 2023 in the PHILJA Training Center in Tagaytay to discuss their proposed amendments to the Rules. 

The technical working group for legal practitioners, led by the Integrated Bar of the Philippines, held its second focus group discussion in Cagayan de Oro on October 22 to 25, 2024.

Legal Practitioners (IBP)

The TWG for the IBP, chaired by Atty. Neri Colmenares, held two separate focus group discussions in Luzon and Mindanao on February 24 to 25, 2024 and October 23 to 24, 2024. During these sessions, the group explored proposed amendments to the RPEC, including the writs of kalikasan and continuing mandamus, with the aim of strengthening the people’s right to a balanced and healthful ecology. 

Academic Community

The TWG for the academe is led by University of the Philippines College of Law Dean Darlene Berberabe and Philippine Association of Law Schools President Teodoro Pastrana. The academe examined the procedural aspects of the RPEC and conducted a comparative analysis of environmental rules across various jurisdictions, including several countries and the European Union.
