The Supreme Court of the Philippines (SC), led by Senior Associate Justice Marvic M.V.F. Leonen, then Acting Chief Justice, and Associate Justice Maria Filomena D. Singh, successfully hosted a delegation from the Federal Court of Australia (FCA), headed by Chief Justice Debra Sue Mortimer. The Australian delegation visited the Philippines from September 22 to 26, 2025, as part of an ongoing judicial partnership.
Justice Singh, Chairperson of the Special Organizing Committee for the FCA Visit, in opening the weeklong activities, described the event as a milestone in implementing the 2024 Memorandum of Understanding (MOU) between the SC and the FCA. The MOU aims to boost long-term collaboration between the two courts and deepen understanding of each other’s legal systems, international standards, and regional developments.
Throughout the five-day study visit, delegates from both courts shared knowledge and experiences on a wide range of topics, including intellectual property, maritime and admiralty law, competition law, class actions, and native land titles. The discussions also covered court administration, communication strategies, and digital transformation—aligned with the SC’s Strategic Plan for Judicial Innovations (SPJI) 2022-2027.
The Australian delegation included FCA Justices Stephen Burley, Sarah Derrington, and Thomas Michael Thawley; Senior National Judicial Registrar Mr. Paul Farrell, Executive Director for Corporate Strategy and Programs Mr. Jimmy Mastorakos, Acting Chief Information and Digital Officer Nathan Price, and International Programs Manager Mr. Martin Clutterbuck.
Day 1: Improving Court Services

The visit began with an informal conversation with the Office of the Regional Court Manager for the 3rd Judicial Region (ORCM JR3) at Shangri-la The Fort, Manila, located in Taguig City. Regional Court Manager Atty. Joevanni A. Villanueva explained how ORCM JR3 has enhanced administrative efficiency, noting that the processing time for leave requests from trial courts has been reduced from 2-3 weeks to just one to two days. Additionally, travel approvals that previously took a month are now completed within a week.
Beyond handling leave applications and travel approvals, the ORCM JR3, through its Regional Financial Management Division and Regional Halls of Justice Division, manages the processing and disbursement of payments for utility bills and minor repairs, which are processed up to a two-million-peso limit for small-value procurement under the Government Procurement Act.

Day 2: Legal Dialogues in Quezon City, Makati, and Cebu

On the second day, the FCA Justices and Mr. Clutterbuck visited the Philippine Competition Commission (PCC) in Quezon City for a Knowledge Exchange on Competition Law. PCC Commissioner Marah Victoria S. Querol welcomed the guests and shared that since its founding in 2016, PCC has reviewed 352 mergers and acquisitions and handled at least 21 enforcement cases for violations of anti-competitive agreements and abuse of dominant position.
Commissioner Querol acknowledged the value of learning from Australia’s more experienced agencies, stating:
“The vast experience of the FCA and our counterpart, the [Australian Competition and Consumer Commission], cannot compare to the PCC, a relatively young competition agency. But nevertheless, we at the PCC, are humbly offering our services, our support to the endeavors of this partnership between the Supreme Court of the Philippines and the FCA.”
Later that day, the FCA delegation went to the Ateneo de Manila University School of Law (ALS) in Makati City for a dialogue with the academe, titled “Justice in Practice: Cross-Jurisdictional Dialogues with the Federal Court of Australia.”

The participants were divided into four groups to exchange views on judicial leadership, institutional design and legal reform; maritime, admiralty and international law; intellectual property, commercial and competition law; and class actions.

Meanwhile, FCA administrative officials Mr. Mastorakos, Mr. Price, and Mr. Farrell visited the Office of the Regional Court Manager for the 7th Judicial Region (ORCM JR7) in Cebu City, led by Regional Court Manager Judge Michelle Ann T. Villahermosa-Gacutno and Deputy Regional Court Manager Limito M. Caraballe, Jr. They learned about the office’s transferred responsibilities from the Office of the Court Administrator.
Later that afternoon, an Informal Dialogue was held at the Radisson Blu Hotel Cebu in Cebu City, where Judge Villahermosa-Gacutno gave an overview of the ORCM JR7 and the functions of each of its divisions. She also shared key takeaways from her 2024 study visit to the FCA in Melbourne, where she participated as part of the SC delegation.
Day 3: Visit to Lapu-Lapu City, Knowledge Exchange in Tagaytay
The FCA administrative officials visited Branch 70 of the Regional Trial Court (RTC) of Lapu-Lapu City, presided by Judge Christine S. Muga-Abad. They also met with Executive Judge Anacleto G. Debalucos of Branch 17, RTC, Cebu City, and Executive Judge Nelson G. Leyco of Branch 27, RTC, Lapu-Lapu City, who provided insights into the Cebu City Justice Zone and evaluated ORCM JR7’s performance.

FCA Justices and Mr. Clutterbuck also went to the Philippine Judicial Academy (PHILJA) in Tagaytay City for the Philippine Judiciary Knowledge Exchange, focusing on Class Actions and Intellectual Property Law.

PHILJA Chancellor and retired SC Associate Justice Rosmari D. Carandang opened the session, noting the wide-ranging topics for the two-day knowledge exchange: from technical aspects of adjudicating to the human and institutional challenges judges face.
Justice Singh, in her keynote message, recalled the 2024 study visit of SC officials to Melbourne, where Philippine pilot Regional Court Managers observed the Australian court system first-hand:
“That was the opportunity for the Philippines to bring over our pilot Regional Court Managers to Melbourne to personally view the processes and how the systems work in the Federal Courts of Australia, and to interact with their principal administrative personnel and officials.”
Justice Singh also mentioned that the Philippine Torrens system was modeled after Australia’s. Although it was created to guarantee the indefeasibility of land titles, titles in the Philippines still face numerous challenges in court. She noted that a delegation led by SC Associate Justice Alfredo Benjamin S. Caguioa recently visited Australia to study its fully digitalized and more fraud-resistant titling system. She expressed optimism that, with the FCA’s support, the Philippines may implement similar reforms within the next five years.
FCA Chief Justice Mortimer, in her keynote, shared how both courts face similar concerns: “not enough resources, dealing with high-conflict and high-stakes situations, the need to remain impartial and independent, to have courage in the discharge of our judicial function, the need to retain and develop our expertise in the law we apply.” She expressed hope that “we can provide each other with real support and encouragement in the judicial task.”
Other speakers included PHILJA professorial lecturer and ALS professor Atty. Luisa Isabel L. Rosales, Manila Adventist College School of Law and Jurisprudence Dean Tranquil Gervacio S. Salvador III, and FCA Justice Thawley who discussed class action suits.
Breakout sessions gave participants the opportunity to delve into key aspects of class actions, including case management planning, completing class actions, communications with class members, and settlement procedures. After the group discussions, participants reconvened to share their insights and present their initial draft entries for the Philippine Benchbook on Multiparty Litigation.
In the afternoon, Sandiganbayan Associate Justice Maria Rowena Modesto-San Pedro and FCA Justice Burley delivered presentations on emerging issues and developments in intellectual property law in the Philippines and Australia, respectively. Following the presentations, Court of Appeals Associate Justice Wilhelmina B. Jorge-Wagan and Executive Judge Romeo D. Tagra of Branch 273, RTC, Marikina City, offered their reflections and responses.
Day 4: Knowledge Exchange on Native Titles and Admiralty Law
On the fourth day, FCA administrative officials joined the rest of the delegation in Tagaytay City. FCA Chief Justice Mortimer and Dean Sedfrey M. Candelaria, PHILJA Chief of the Research, Publications, and Linkages Office, presented the legal frameworks on native title in Australia and the Philippines. Senior Associate Justice Leonen and Professor Anthony Charlemagne C. Yu, Chair of the PHILJA Constitutional Law Department, also shared their perspectives.
The afternoon session focused on admiralty law, with presentations from FCA Justice Derrington; Judge Virgilio V. Macaraig, Branch 37, RTC, Manila City; and Atty. Lee Edson P. Yarcia, Senior Lecturer at the University of the Philippines College of Law, who offered a comparative synthesis of laws in their respective countries.
In his closing remarks, PHILJA Vice Chancellor and retired SC Associate Justice Edgardo L. De Los Santos remarked that the event provided the opportunity to learn from one another and strengthen judicial cooperation between both countries.
Day 5: Courtesy Call and Presentations
The study visit ended with a courtesy call on Senior Associate Justice Leonen and the Members of the Court at Shangri-la The Fort. The Supreme Court provided updates on digital transformation, administrative modernization, and media and communication strategies.

FCA Chief Justice Mortimer expressed her gratitude for their week-long study visit, saying,
“What we’ve seen in a lot of the material that we’ve been presented with is the use of that word “exchange.” And I think that’s an absolutely apt description of what we’ve done this week. There’s been no dominant partner in this relationship. We are both bringing our experience, our sense of challenges, our optimism and our quest for improvement. And we have truly had a really meaningful exchange every day, every session this week.”

Senior Associate Justice Leonen also thanked the FCA, remarking that “this international exposure that we have had has given us a broader view of how we should administer justice in the Philippines as well as how we should adjudicate a lot of cases.”
He also commended SC Associate Justices Singh and Kho, Chairperson and Co-Chairperson of the Special Organizing Committee for the FCA Visit, for successfully leading the event despite many challenges. He expressed pride in the dedication and professionalism of all Court officials and personnel involved.
The study visit was capped with a planning session for 2026 projects under the MOU and SPJI, attended by Senior Associate Justice Leonen and Justice Singh; FCA Chief Justice Mortimer and Justice Burley; and other court officials.
