The Supreme Court (SC) En Banc, during its session today, January 21, 2025, acted on the following petitions in the 2025 national and local elections:
G.R. No. 277280, Francis Leo Antonio Marcos (Marcos) v. Commission on Elections (COMELEC)
Francis Leo Antonio Marcos is challenging the Commission on Elections (COMELEC) Resolutions that labeled him a nuisance candidate and revoked his Certificate of Candidacy (COC) for Senator. The COMELEC decided that Francis Marcos did not show a genuine intent to run for office, even though he was allowed to run for Senator in the 2022 elections, where he received 4,477,024 votes.
The SC issued a temporary restraining order (TRO) preventing the COMELEC from declaring Marcos a nuisance candidate. The SC also ordered the COMELEC to comment on his petition within a non-extendible period of five days from receipt of notice.
G.R. No. 277739, Noel Ebriega Rosal v. COMELEC and Josefino Valenzuela Dioquino
Noel Rosal is challenging the COMELEC Resolutions cancelling his COC for Albay Governor. Respondent Dioquino prayed for the automatic administrative cancellation of Rosal’s COC because the Ombudsman had dismissed Rosal from service, which carries the penalty of perpetual disqualification to hold public office.
The SC issued a TRO preventing the COMELEC from implementing the Resolutions cancelling Rosal’s COC. The SC also ordered the COMELEC to comment on Rosal’s petition within a non-extendible period of five days from receipt of notice. (Courtesy of the SC Office of the Spokesperson)
